Terms and Conditions

These terms and conditions (the "Terms and Conditions") govern the use of www.jaysabilltoolboxes.ca (the "Site"). This Site is owned and operated by Jay SaBill Industries Inc.. This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

 

Intellectual Property


All content published and made available on our Site is the property of Jay SaBill Industries Inc. and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

 

Acceptable Use

 

As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

  • Violate the intellectual property rights of the Site owners or any third party to the Site;

  • Hack into the account of another user of the Site; or

  • Act in any way that could be considered fraudulent.

 

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

When you create an account on our Site, you agree to the following:

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and

  2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

 

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

 

Sale of Goods And Services


These Terms and Conditions govern the sale of goods and services available on our Site.

 

The following goods are available on our Site:

  • Tool Boxes/Chests and accessories; and

  • Tools.

 

The following services are available on our Site:

​

  • Delivery of items purchased from Jay Sabill Tool Boxes.

 

The services will be paid for in full when the services are ordered.

These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

 

Payments

 

We accept the following payment methods on our Site:

  • Credit Card;

  • Debit;

  • Arrangement through Klarna and

  • Interac E-transfer.

 

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Returns

​

There is no option for returning a purchase except as expressly provided below.

​

If you are unsatisfied with your purchase, you can return it to us for a refund or exchange within 30 days of receiving the product under the conditions explained in this section.

​

Before returning any items, customers must contact our customer support team to get your return authorization by email info@jaysabilltoolboxes.ca or call (905) 601-8665.. We are available Monday to Friday from 9 am to 5 pm ET

Defective Merchandise

​

If you receive a defective item, you may return it within 30 days of receiving the item. We will provide you with a prepaid return shipping label, and you can choose to have the item replaced or receive a full refund.

​

A full refund or a replacement will be issued once we receive the item and the defect is confirmed.

​

Non-Defective Merchandise

 

If you wish to return an item that is not defective, you must contact us within 30 days of receiving the item. We will process a refund; however, you will be responsible for any and all original and return shipping expenses.

 

Additional Return Conditions

​

All returned merchandise must be in its original condition and include the following:

​

Original packaging (including original box, Styrofoam, bubble wrap, plastic bags, etc.)

Original intact UPC barcode, if any. Removal of the UPC voids any possibility of the return request being honored.

All accessories, including cords, side tables, etc.

All manufacturer instruction manuals, warranty cards, registration information, and other documentation, if any.

 

Please securely pack the product to ensure there is no damage to the returned item during transit. Any additional costs incurred due to damage during the return shipping process will be the customer's responsibility.

 

All returns are subject to inspection by our warehouse team within 48 hours of receipt to confirm its condition.

Please wait 3 to 5 business days for the refund to be credited to the original payment method you used to place your order.  Cash purchases will be refunded via cheque or ETF at our discretion. 

 

Return In Person

​

You may return the product in person to our warehouse location at M6M 4L8.  The exact address will be provided when the return authorization is processed as described above.

​

Refunds for Services
All services sold on our Site are non-refundable.

​

Consumer Protection Law


Where the Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

 

Warranty

 

Many of the products sold by Jay SaBill Tool Boxes have one or more blemishes or imperfections in their appearance. These can include, but are not limited to, dents, scratches, scrapes, scuffs and other abnormalities.  Jay SaBill Tool Boxes will make reasonable efforts to make the purchaser aware of the abnormalities before the purchase.  Jay SaBill Tool Boxes does not warrant these abnormalities.

​Notwithstanding the above, Jay SaBill Tool Boxes warrants to the original purchaser that this product is free from defects in materials and workmanship impacting the product's functionality for the period of 90 days beginning on the date the item enters the purchaser's custody and control.

 

This warranty does not apply to damage due directly or indirectly, to misuse, abuse, negligence or accidents, repairs or alterations outside our facilities, criminal activity, improper installation, normal wear and tear, or to lack of maintenance. We shall in no event be liable for death, injuries to persons or property, or for incidental and contingent, special or consequential damages arising from the use of our product.

Jay SaBill Tool Boxes makes no representation whatsoever that its products, in whole or in part, are warrantied by any third-party, including but not limited to the manufacturer(s).

Limitation of Liability
Jay SaBill Industries Inc. and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

 

Indemnity


Except where prohibited by law, by using this Site you indemnify and hold harmless Jay SaBill Industries Inc. and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law


These Terms and Conditions are governed by the laws of the Province of Ontario.

 

Severability


If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. We reserve the right at any time to modify or discontinue a Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
